Platform Service Agreement

This Platform Service Agreement (“Agreement”) governs your use of the Portugal Tattoo booking marketplace platform, operated by Drifter Apps Unipessoal Limited (VAT:PT515983128), hereinafter DRIFTER. This Agreement supplements our Terms of Service and specifically addresses the marketplace nature of our platform and the relationship between Portugal Tattoo, customers, and artists.

Drifter Apps Unipessoal Limited is the parent company that owns and operates Portugal Tattoo. Portugal Tattoo is a subsidiary brand of Drifter Apps Unipessoal Limited. All references to Portugal Tattoo in this document refer to services and operations conducted by Drifter Apps Unipessoal Limited under the Portugal Tattoo brand name.
General Terms and Conditions
By using the Portugal Tattoo platform, you ("you," "your," "User") understand, agree, and accept the terms and conditions of this Platform Service Agreement ("Agreement"), as amended by us from time to time. This Agreement supplements our Terms of Service and specifically addresses the marketplace nature of our platform. Portugal Tattoo (operated by Drifter Apps Unipessoal Limited) and its affiliates (together, "Portugal Tattoo," "we," or "us") operates the Portugal Tattoo booking marketplace platform (the "Platform") and provides booking and payment processing services to facilitate connections between customers and independent tattoo artists. You acknowledge and agree that your relationship with Portugal Tattoo and use of the Platform will also be governed by our Terms of Service, Privacy Policy, Refund Policy, and other platform policies, which are incorporated herein by reference. You agree that your use of the Platform constitutes acceptance of this Agreement and all incorporated policies, which are binding written contracts.
Platform Role and Marketplace Nature
Portugal Tattoo operates as an intermediary marketplace platform that connects customers with independent tattoo artists. We provide: (a) Booking and scheduling tools; (b) Payment processing services; (c) Communication tools between customers and artists; (d) Artist profiles, portfolios, and review systems. IMPORTANT: Portugal Tattoo is NOT a party to the actual tattoo service agreement between customers and artists. Artists are independent contractors, not employees or agents of Portugal Tattoo. Portugal Tattoo does not provide tattoo services, does not control artist work, and is NOT responsible for: (i) Tattoo quality, outcomes, or appearance; (ii) Artist workmanship, skill, or technique; (iii) Health outcomes, complications, or reactions; (iv) Disputes between customers and artists regarding the tattoo itself. The Platform acts solely as an intermediary facilitating bookings and payments. All tattoo services are provided directly by independent artists who operate their own businesses.
Critical Disclaimer - Platform Liability Limitation
PORTUGAL TATTOO IS A BOOKING PLATFORM AND MARKETPLACE INTERMEDIARY. WE ARE NOT RESPONSIBLE FOR TATTOO QUALITY, OUTCOMES, OR ARTIST WORK. Customers are solely responsible for: (a) Reviewing artist portfolios and previous work before booking; (b) Reading customer reviews and ratings; (c) Verifying artist credentials and licensing; (d) Communicating directly with artists about design expectations, placement, and any concerns; (e) Making informed decisions about which artist to book. The platform provides reviews, ratings, and portfolios as informational tools to help you make decisions, but Portugal Tattoo does not guarantee, endorse, or warrant the quality of any artist's work or services. Artists are independent contractors responsible for their own services, compliance with health regulations, and customer satisfaction regarding tattoo services.
Compliance with Applicable Laws
You understand and agree that you are solely responsible for ensuring that your use of the Platform complies with this Agreement, all platform policies, and all applicable laws, rules, and regulations, including without limitation: GDPR and data protection laws, consumer protection laws, health and safety regulations (for artists), business licensing requirements (for artists), tax obligations, and any other laws applicable to your use of the Platform or your activities as a customer or artist. Portugal Tattoo has no obligation to ensure your compliance with applicable laws, though we reserve the right to take action if we become aware of violations.
Booking Services and Payment Processing
Portugal Tattoo provides booking and payment processing services to facilitate transactions between customers and artists. When you book an appointment: (a) You enter into a direct agreement with the artist for the tattoo service; (b) Portugal Tattoo processes payments on behalf of the artist; (c) Artists may require deposits, with amounts and policies varying by artist; (d) Full payment terms, cancellation policies, and refund policies are set by individual artists and displayed at booking; (e) You agree to the artist's specific terms for that booking. Portugal Tattoo charges platform service fees (disclosed at booking) for providing booking and payment processing services. These fees are separate from artist fees and are non-refundable except in cases where the artist cancels or in other exceptional circumstances. Portugal Tattoo does not hold customer funds beyond the time necessary to process payments to artists.
User Eligibility and Account Requirements
To use the Platform, you must: (a) Be at least 18 years of age; (b) Have legal capacity to enter into contracts; (c) Provide accurate and complete information when creating an account; (d) Maintain the security of your account credentials; (e) Comply with all platform policies and applicable laws. Artists must additionally: (f) Have appropriate business licensing and health permits as required by local law; (g) Maintain professional standards and ethical conduct; (h) Comply with health and safety regulations. Portugal Tattoo reserves the right to verify user information, refuse service, suspend accounts, or terminate accounts that violate this Agreement or engage in fraudulent or harmful activity.
Artist Independence and Responsibilities
Artists using the Platform are independent contractors, not employees, agents, or representatives of Portugal Tattoo. Artists are solely responsible for: (a) Their own services, pricing, and policies; (b) Compliance with health codes, business licensing, and tax obligations; (c) Maintaining appropriate insurance; (d) Customer service and dispute resolution regarding tattoo services; (e) The quality and outcome of their work; (f) Professional standards and ethical conduct. Portugal Tattoo does not control, supervise, or direct artist work. Artists operate independently and are responsible for all aspects of their business operations. Portugal Tattoo is not liable for artist conduct, services, or business practices.
Customer Responsibilities
As a customer, you are responsible for: (a) Providing accurate information when creating bookings; (b) Arriving on time for appointments or providing adequate notice for cancellations; (c) Following artist instructions regarding preparation, aftercare, and health requirements; (d) Communicating clearly with artists about design expectations, placement, size, and any concerns; (e) Making informed decisions by reviewing artist portfolios, reviews, and credentials before booking; (f) Complying with artist policies regarding cancellations, deposits, and refunds; (g) Treating artists and their studios with respect. You acknowledge that tattoo outcomes depend on many factors including your skin type, healing process, and aftercare, and that Portugal Tattoo is not responsible for tattoo results. Disputes about tattoo quality or outcomes must be resolved directly with the artist.
Fees and Payment Processing
Portugal Tattoo charges platform service fees for providing booking and payment processing services. These fees are disclosed at the time of booking and are separate from artist fees. Platform fees are generally non-refundable except in cases where: (a) The artist cancels the booking; (b) Portugal Tattoo experiences technical issues preventing booking completion; (c) Other exceptional circumstances as determined by Portugal Tattoo in its sole discretion. Payment processing is handled securely through certified payment providers. Portugal Tattoo processes payments on behalf of artists but is not responsible for refunds related to tattoo services, which are governed by individual artist policies. Dispute Resolution
Disputes regarding tattoo services, quality, outcomes, or artist conduct must be resolved directly between the customer and artist. Portugal Tattoo is not a party to these disputes and is not responsible for resolving them. For disputes related to platform functionality, payment processing errors, or violations of this Agreement, please contact Portugal Tattoo at legal@portugaltattoo.com. Any disputes arising out of or relating to this Agreement or the Platform (excluding disputes about tattoo services themselves) shall be settled through good faith negotiations. If negotiations fail, disputes shall be resolved through the competent courts of Portugal, in accordance with Portuguese law. For EU residents, nothing in this Agreement limits your rights under applicable consumer protection laws.
GDPR and Data Protection
By using the Platform, you affirm that you have read and consent to our Terms of Service and Privacy Policy, which includes our collection and maintenance of your personal information in accordance with the General Data Protection Regulation (GDPR) and applicable data protection laws. You agree that Portugal Tattoo may provide electronically any required privacy notices or updates to the Privacy Policy. You also agree to transact business with Portugal Tattoo and receive communications electronically. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PORTUGAL TATTOO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (a) YOUR USE OR INABILITY TO USE THE PLATFORM; (b) ANY CONDUCT OR CONTENT OF THIRD PARTIES (INCLUDING ARTISTS) ON THE PLATFORM; (c) ANY TATTOO SERVICES, OUTCOMES, OR RESULTS; (d) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR CONTENT OR DATA. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRIOR TO THE CLAIM. Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.
