Terms of Service

Welcome to Portugal Tattoo, a marketplace platform that connects customers with tattoo artists for booking appointments. These Terms of Service ("Terms") are a legal contract between you and Portugal Tattoo ("we," "our," or "us"). By accessing or using our platform, you indicate that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the platform. Portugal Tattoo operates as an intermediary platform facilitating connections between customers and independent tattoo artists. We provide booking services, payment processing, and communication tools, but we are not a party to the actual tattoo service agreement between customers and artists.

Portugal Tattoo is a booking marketplace that enables customers to discover, book, and pay for tattoo appointments with independent tattoo artists. Our platform provides: (a) Artist profiles, portfolios, and reviews; (b) Booking and scheduling tools; (c) Payment processing services; (d) Communication tools between customers and artists; (e) Review and rating systems. Artists on our platform are independent contractors, not employees or agents of Portugal Tattoo. Each artist operates their own business and is responsible for their own services, pricing, policies, and compliance with applicable laws and regulations.

IMPORTANT: Portugal Tattoo is a booking platform and marketplace intermediary. We are NOT responsible for: (a) The quality, outcome, or appearance of tattoos; (b) Artist workmanship, skill, or technique; (c) Health outcomes, complications, or reactions related to tattoos; (d) Disputes between customers and artists regarding the tattoo itself; (e) Artist licensing, credentials, or compliance with health regulations; (f) The accuracy of information provided by artists on their profiles. Customers are solely responsible for: (a) Reviewing artist portfolios and previous work before booking; (b) Reading customer reviews and ratings; (c) Verifying artist credentials and licensing; (d) Communicating directly with artists about design expectations, placement, and any concerns; (e) Making informed decisions about which artist to book. The platform provides reviews, ratings, and portfolios as tools to help you make informed decisions, but Portugal Tattoo does not guarantee, endorse, or warrant the quality of any artist's work or services.

We may modify, update, or change these Terms at any time. We will notify you of material changes by posting the updated Terms on the platform with a new "Updated date" and, where appropriate, by sending you an email notification. Your continued use of the platform after any changes constitutes your acceptance of the modified Terms. If you do not agree to any modifications, you must stop using the platform and may request deletion of your account, subject to our legal obligations to retain certain information.

You must be at least 18 years of age to use Portugal Tattoo. By using the platform, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into these Terms. If you are using the platform on behalf of a business entity, you represent that you have the authority to bind that entity to these Terms. We reserve the right to verify your age and identity at any time, and to refuse service to anyone for any reason, including if we suspect fraudulent activity or violation of these Terms.

To use certain features of the platform, you must create an account. You may create either a customer account or an artist account. When creating an account, you must provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account. You may not create multiple accounts, transfer your account to another person, or use another person's account. We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent or harmful activity.

When you book an appointment through Portugal Tattoo: (a) You enter into a direct agreement with the artist for the tattoo service; (b) Portugal Tattoo processes payments on behalf of the artist; (c) Artists may require deposits to secure bookings, with amounts and policies varying by artist; (d) Full payment terms, cancellation policies, and refund policies are set by individual artists and displayed at the time of booking; (e) You agree to the artist's specific terms for that booking. Payment processing is handled securely through our platform. All prices are displayed in the currency specified on the platform. You are responsible for any additional fees charged by your payment provider or financial institution.

Artists using the platform are independent contractors responsible for: (a) Providing accurate information about their services, pricing, and availability; (b) Maintaining appropriate licensing and compliance with health and safety regulations; (c) Delivering services as described and agreed upon with customers; (d) Handling their own customer service and dispute resolution regarding tattoo services; (e) Complying with all applicable laws, including health codes, business licensing, and tax obligations; (f) Maintaining professional standards and ethical conduct. Artists are not employees, agents, or representatives of Portugal Tattoo, and Portugal Tattoo is not responsible for artist conduct or services.

As a customer, you are responsible for: (a) Providing accurate information when creating bookings; (b) Arriving on time for appointments or providing adequate notice for cancellations; (c) Following artist instructions regarding preparation, aftercare, and health requirements; (d) Communicating clearly with artists about design expectations, placement, size, and any concerns; (e) Making informed decisions by reviewing artist portfolios, reviews, and credentials before booking; (f) Complying with artist policies regarding cancellations, deposits, and refunds; (g) Treating artists and their studios with respect. You acknowledge that tattoo outcomes depend on many factors including your skin type, healing process, and aftercare, and that Portugal Tattoo is not responsible for tattoo results.

Cancellation and modification policies are set by individual artists and displayed at the time of booking. You must comply with the artist's specific policy for your booking. Generally: (a) Customers may cancel or reschedule through the platform or by contacting the artist directly; (b) Refund eligibility depends on the artist's policy and timing of cancellation; (c) Artists may cancel bookings due to emergencies or other circumstances, in which case customers are entitled to full refunds; (d) Portugal Tattoo may charge processing fees for certain cancellations as disclosed at booking. The platform allows customers to leave reviews and ratings for artists after appointments. Reviews must be: (a) Truthful and based on actual experiences; (b) Free from defamatory, libelous, or illegal content; (c) Respectful and professional; (d) Not containing personal attacks or discriminatory language. Portugal Tattoo reserves the right to remove reviews that violate these guidelines or our community standards. Reviews are provided as informational tools and do not constitute endorsements or guarantees by Portugal Tattoo. We are not responsible for the accuracy of reviews, though we take measures to ensure authenticity.

All content on the platform, including text, graphics, logos, images, software, and the platform itself, is the property of Portugal Tattoo or its licensors and is protected by copyright, trademark, and other intellectual property laws. Artist portfolios, images, and content uploaded by artists remain the property of the respective artists, who grant Portugal Tattoo a license to display such content on the platform. You may not copy, reproduce, distribute, modify, create derivative works, publicly display, publicly perform, republish, download, store, or transmit any content from the platform without prior written permission, except for your own personal, non-commercial use.

You agree not to use the platform: (a) For any illegal purpose or in violation of any laws; (b) To transmit harmful code, viruses, or malicious software; (c) To impersonate any person or entity or misrepresent your affiliation; (d) To harass, abuse, threaten, or harm artists, customers, or platform staff; (e) To post false, misleading, or fraudulent information; (f) To interfere with or disrupt the platform's operation or security; (g) To attempt to gain unauthorized access to any part of the platform; (h) To use automated systems to scrape, crawl, or extract data from the platform without permission; (i) To book appointments with no intention of attending (no-show bookings); (j) To circumvent platform fees or payment systems. Violation of these prohibitions may result in immediate account termination and legal action.

Disputes regarding tattoo services, quality, outcomes, or artist conduct must be resolved directly between the customer and artist. Portugal Tattoo is not a party to these disputes and is not responsible for resolving them. We encourage: (a) Direct communication between customers and artists to resolve issues; (b) Professional and respectful conduct in all interactions; (c) Review of artist policies and portfolios before booking to set appropriate expectations. Portugal Tattoo may, at its discretion, facilitate communication or provide tools to help resolve disputes, but we are not obligated to do so and our involvement does not make us responsible for the dispute or its resolution. TO THE MAXIMUM EXTENT PERMITTED BY LAW, PORTUGAL TATTOO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (a) YOUR USE OR INABILITY TO USE THE PLATFORM; (b) ANY CONDUCT OR CONTENT OF THIRD PARTIES (INCLUDING ARTISTS) ON THE PLATFORM; (c) ANY TATTOO SERVICES, OUTCOMES, OR RESULTS; (d) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR CONTENT OR DATA. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRIOR TO THE CLAIM. Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your personal information when you use the platform. By using the platform, you consent to the collection and use of your information as described in our Privacy Policy.

By using the platform, you consent to receiving electronic communications from us, including via email, SMS, and in-app notifications. These communications may include booking confirmations, appointment reminders, payment receipts, platform updates, and promotional materials (you may opt out of promotional communications). You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.

We may terminate or suspend your account and access to the platform immediately, without prior notice, for conduct that we believe violates these Terms, is harmful to other users, artists, or Portugal Tattoo, or for any other reason. You may terminate your account at any time by contacting us at legal@portugaltattoo.com. Upon termination: (a) Your right to use the platform will immediately cease; (b) We may delete your account and data, subject to our legal obligations to retain certain information; (c) Any pending bookings may be cancelled according to artist policies; (d) Provisions of these Terms that by their nature should survive termination will survive, including intellectual property, disclaimers, and limitation of liability provisions.

These Terms shall be governed by and construed in accordance with the laws of Portugal, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the platform shall be resolved through good faith negotiations. If negotiations fail, disputes shall be subject to the exclusive jurisdiction of the courts of Lisbon, Portugal. For EU residents, nothing in these Terms limits your rights under applicable consumer protection laws.
